General House Rules Information Check-in time is 4pm / Check-out time is 11am. Sometimes the platform will allow you to select the time in which you would like to arrive and or exit. Please know that check in is always at 4PM and checkout at 11AM unless explicitly discussed and approved with us. Monroe County ordinance quiet hours 10pm-8am. No smoking inside the house ($1000 fine) **House Rules Intro** We have created our house rules sheet to preserve the integrity of your stay and future stays while also respecting the home and neighborhood! Following these rules will greatly help us as Vacation Rental hosts by making sure the home is taken care of during your stay. We understand that people are not a “one size fits all” category, so please reach out to us with any questions or concerns in this document. COMMUNICATION IS KEY!!!! Mi casa, tu casa! But you wouldn’t intentionally damage or mess up your home, would you? We ask that you treat our property as if it was your very own as well! Please be aware of the condition of items in the house, and if you happen to notice anything broken when you arrive, please contact us to let us know. We also ask that you please watch noise levels at night. We love our neighbors! They’re nice, we’re nice to them, and we hope you are nice to them too! Noise ordinances for quiet time in the city/neighborhood are at 10pm, so please respect these rules. Should payments be made with a credit card, a 6% processing fee applies to all payments and is non-refundable. Please notify the host should you wish to make a payment this way and they may be able to accommodate you. For this option the following items are required: A picture of your driver’s license. A picture of the front and back of the credit card used. A picture of you holding your license up to your face in a selfie form. A credit card authorization form. (Please note that all of the above required items names must match the credit cards, licenses, and name on the reservation.) Should any cancellations or refunds be given, they will be provided less the 6% processing fee. A/C Central System Please do not have the AC thermostat below 60 degrees as this can freeze the ac unit causing damages that we will then pass along to you. Acknowledgement YOU AND THE GROUP ACCOMPANYING YOU FURTHER UNDERSTAND, INTEND AND DESIRE TO RELEASE THE MANAGER PARTIES FROM ANY AND ALL LIABILITY ARISING FROM OR RELATED TO THE OCCUPANCY OF THE PROPERTY TO THE FULLEST EXTENT PERMITTED BY THE LAWS OF THE STATE OF FLORIDA. You hereby certify that you are at least 18 years of age and you are legally competent to enter into this Agreement, including the Release, Waiver, Assumption and Indemnity provisions contained herein. You agree that it is your express intent that this release shall bind the members of your family and spouse, if you are alive, and your heirs, assigns and personal representatives, if you are deceased, and shall be governed by the laws of the State of Florida. BBQ Grill Any guests who plan to use our BBQ grill are welcome to do so, but please only use it if you are familiar with propane gas grills. Before & after each use, please turn on & off the propane tank by reaching under the grill and twisting the handle clockwise (open) or counterclockwise (close). In order to minimize a messy clean up, we ask that guests use foil and/or clean up the grill after use scraping the grill clean. We don’t want to have grease as a fire hazard. These are communal grills. The grill is clean and we’d like everyone to experience it that way! Any excess cleaning will result in additional cleaning fees. We cannot stress this enough! Our cleaners will charge us for additional cleaning, and we will in turn charge you. Booking When you book, you are agreeing to pay all charges for your booking including the Listing price, applicable fees like, taxes, and any other items identified during checkout (collectively, “Total Price”). You are also agreeing that C’est La Vie Home Away by Jordan Mikes LLC via Cosmic Property Management or their partners may charge the Payment Method used to book the Listing in order to collect Damage Claim amounts. When you receive the booking confirmation/invoice, a contract for Host Services (a "Reservation") is formed directly between you and the Host. In addition to these Terms, you will be subject to, and responsible for complying with, all terms of the Reservation, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Reservation. It is your responsibility to read and understand these rules, standards, policies, and requirements prior to booking a Listing. Be aware that some Hosts work with a co-host or as part of a team to provide their Host Services. Broken items If for any reason you break an item during your stay, please let us know immediately. We understand that accidents happen, but in order for us to fix or replace something for a future guest to enjoy, we will need to know that it is broken. We really appreciate your honesty. We take inventory of every single item in the home when it is being cleaned, including linens, appliances, towels, and decorations. If anything is missing - this will result in a fee equal to the item’s 150% replacement value. Check-in Check-in time is from 4:00pm -12:00am. If you have a late/delayed flight, please let us know as soon as possible and we will be happy to work with you. Early check-ins are available upon request, however please understand that we cannot make any guarantees until the day of or before. If you are interested in an early check in, please reach out to us and we will let you know what the additional cost would be. Please only use the smart locks to access in and out of the unit. If you use anything other locks and lock yourselves out, we will not be liable for any additional charges and expenses associated with this. It will be charged to you. 12:30pm check-in: $300 2pm check-in: $200 Check-out Check-out time is 11am. Late checkouts are based on availability and an additional fee of $150/per hour. Unless otherwise authorized by us, please give us a 24-hour notice for late checkout requests or if you would like to extend your stay with us. Please keep in mind that we will try our best to accommodate these requests however we cannot make any guarantees that we will be able to honor your request. If you use anything other locks and lock yourselves out, we will not be liable for any additional charges and expenses associated with this. It will be charged to you. Any guest who stays after the 11am checkout time without requesting it from us previously or stays despite having their request denied will be charged an additional night’s stay and will be forced to vacate. Should we experience any cancellations or losses in our calendar arising from any check out related complications from you or any guests, you will be charged for the next booking. Prior to leaving please place a load of regular towels and beach towels to wash. This will help our cleaners get a head start for our next guest. Checking for & Report Damages/Issues Please note that like any home, our property may have normal wear and tear. We try our hardest to fix, replace, and bring back our property to its original form in between guests and reservations but sometimes it’s just not feasible and sometimes our previous guests don’t mention it to us. It’s your responsibility to let us know of any damages or issues you may have with the home or you forfeit the right to later deny any damages or make claims about the state of the home. All issues should be reported within the first 3 hours of entry. When reporting the issues please notify us with evidence of the issue. For example, broken blender: image or video showing that the blender does not function. For any claims that cannot be photographed, for example, a smell, we ask that guests (at their own expense) involve a neutral 3rd party professional to assess the home to validate their claims. Evidence of this must be supported and legitimized. Children’s Safety Children are always welcome! After all, we have our own offspring! However, please keep your children safe. Our home is not childproofed. There is no pool barrier and we do not recommend using the jacuzzi tub for children. Commercial Photography & Filming Guests must ask the host prior to booking if booking is done with the intent to do any commercial photography or filming. We have the right to decline any type of photography and filming. If your request is approved, please note an additional $500 fee applies to all reservations booked with the intent to film or have commercial photography. In addition, mention of our property is mandatory as a location credit @CestLaVieHomeAway. Should you decline the added fee and state that filming and/or photography will no longer take place to avoid the fee, please know that a fee will still be obliged to pay as once you are in the home, we won’t have cameras to confirm or deny that you will or will not be following through with the photography/filming. Common Concerns By booking this home, you acknowledged that scuff marks on the wall do not constitute as an unclean/unsanitary home or a misleading/altered representation of the images online. We do have our house managers scheduled monthly to come out and retouch the paint, however, in between this timeframe, it is possible for other guests to create new scuff marks in the home. As guests have damaged inventory such as decor, minor appliances, and furniture, we have had to replace items. Keep in mind sometimes the original items pictured had to be replaced with similar items as the original items may no longer be available. You further acknowledge that the hot tub/pool (if applicable) may have sand minor debris inside. The hot tubs get drained every couple of weeks and as our guests typically enjoy the nearby beaches, sand is a typical occurrence in these areas. Pools are serviced with chemicals and provided a clean weekly, sometimes this can cause blurry water that typical clears in a few hours. The hot tubs get checked for their chemical balance in between each clean and added the proper chemicals accordingly. They get drained and refilled every two weeks. Communal Living Areas All outdoor areas including the outdoor grill, hammock, chairs, pool area, pool loungers, kayaks, paddleboards, communal bathroom, and picnic table are available on a first come, first serve basis. We expect all tenants to be respectful of the other guests. Should anyone become unruly, they will be given one warning and then if that isn't enough to move the needle, they will be escorted off the premises by law enforcement. The entire communal area will be under surveillance. Nudity is forbidden in the communal area. If you're bringing a pet, please make sure they are leashed at all times in the communal area. If we receive a complaint about pet waste not being collected we will review the cameras to see who did and charge the excessive pet waste fee to them on behalf of our cleaners. As much as we love pets, not everyone else does. Please be respectful of the other guests who might not appreciate loose dogs running up to them. Communal areas hours are subject to change without warning. At this time, it is available until sundown. Confetti & Other Decor Decorations and confetti are strictly prohibited unless previously discussed and approved. Our cleaners will charge additionally for an excessive clean as it’s incredibly hard to remove. The fees will be passed along to you. Contact Information In the event that we must reach you, it’s imperative that we have confirmed a valid point of communication. The platforms sometimes provide outdated contact information whether it be an old email address or phone number. If your phone number is from outside of the country, please provide us with a local reachable way to be able to call you. In the event of an emergency and/or issue we need this information. Please send us your contact information. We will not provide the access code until we have secured a valid point of contact. Deposit A security deposit may be required to reserve the home, depending on a few various factors. Please reach out to us prior to booking to find out if we will require one for your stay. The deposit is held to prevent damages/inconveniences from occurring. The deposit will be refunded to you after the cleaner’s report has been provided and the following provisions are met: *No damage is done to the unit or its contents *No excessive cleaning is required *No linens are missing, damaged, or excessively stained *The Occupancy limit of the house is not exceeded at any time unless approved in writing in advance *There are no police enforcement actions by the City or Homeowners /and there are no violations of house rules as posted in the house. Any types of damages or inconveniences that occur like the ones listed above will be subject to additional fees. Any evidence we collect that suggests added fees should have been applied based on our house rules will be deducted from the security deposit. Dishes Please load the dishwasher or wash the dishes prior to checking out if you have used any dishes. You will find dishwasher capsules under the kitchen sink. (Dishwasher where applicable) Feel free to run the dishwasher during your stay if needed. Please do not put plastic dishes in the dishwasher as they will melt in the heat. Elevators The elevator is a great amenity to have at your house during your stay allowing for ease up and down all levels of the home. In order for the elevator to function properly, please follow these ELEVATOR INSTRUCTIONS: The accordion door and main doors to the elevator (on all floors) must be closed tightly before and after each use in order for the elevator to recycle. This will allow the elevator to be called from any level. If this is not done properly, it will cause the elevator to need a reset and we can tend to this while our handyman is on site. If the handyman is not on site at the time that this occurs, we will not be able to offer refunds on the matter. False Reservations Any reservation obtained under false pretense will be subject to cancellation and forfeiture of advance payment and the guests will not be permitted to check in to the property. We have the right to request ID and if it doesn’t match the name on the reservation or this is a 3rd party booking reservation, your reservation will be cancelled without refund. Fireworks & Firearms All guests agree that there will be absolutely NO USE of fireworks or any other explosives anywhere near the property. Firearms and other weapons are strictly prohibited in our units. Any evidence of firearms on our property will result in the termination of your stay without refund. FURNITURE & HOME AT TIME OF CHECKOUT Upon checking out, please make sure that our house looks reasonably neat- just like the way you found it. Although we pride ourselves on cleanliness, we do not expect you to scrub it clean but it must be reasonably “picked up” and furniture placed as it was at check-in. Make sure to collect all personal belongings. Check all closets, drawers, washer/ dryer. We are not responsible for any items left behind. Guest Access All areas of the property are for guest use unless there is a lock on it. Please do not tamper with any locks on the property unless we give our permission. All monitoring devices are not to be tampered with. This includes our cameras, noise detection devices, any previously plugged in devices that may be set with a timer for automation purposes, gateway plug-ins, and any of our locked storages/cabinets. Do not touch any pool equipment apart from the pool pump/spa blower (if applicable.) Any violation of the above rules can result in immediate termination of your stay without a refund as well as potential charges to reset, reprogram, or any repairs associated with the tampering of our items. Guest Interaction We love to meet and greet all guests when possible. However, in today’s world, we understand that most people would rather skip the pleasantries. Because of this, we offer self-check-in with a door code. Please keep in mind that we have the right to ask for ID, the credit card used for booking, or other forms of proof of identity and payment. We may also ask guests to present an ID. As long as your guests can confirm trip details, they too can reach out to us with any questions and concerns. Guest Screening I give permission to the property manager to use a third-party to screen my identity and check criminal databases to confirm my reservation. Complete terms regarding the guest screening can be provided by the property manager. You may receive an email to complete your screening. Please check your spam inbox for this email and contact the property manager if you have any questions. Hot Tub Emergency Spa Stop Everyone loves a good hot tub! So please DO NOT press the red stop button. The spa is on a timer and will either stop when the time runs out or if you’d like to speed up the process, you can adjust the timer to have the spa jets stop. If you do press the stop button, it will not only stop the jets but shut down the entire spa, until we need to manually reset it. This means the heating element will also stop causing the heat to go down and making the hot tub less hot and enjoyable! (Not just for you but for others too!) Home Use All guests shall use the property for legal purposes only and other use, such as but not limited to, illegal drug use, abuse of any person, harboring fugitives, etc, shall cause termination of the agreement with no refund of stay or deposits. Identification Required Must be 25 and up to rent. For security purposes, please upload a copy of your photo ID within 72 hours of booking (if booking in advance) or prior to entering the premises if you have a reservation starting soon to the AIRBNB chat. Please note if this is not provided we reserve the right to cancel the reservation with no refund. Indemnification of Manager You and all occupants shall, jointly and severally, defend, indemnify and hold C’est La Vie Home Away By Mikes Group LLC (including its members, officers, employees, subcontractors, agents and representatives) and the Owner (the “Manager Parties”), harmless from any and all claims, liabilities, losses, costs and expenses (including, but not limited to, reasonable attorneys’ fees and costs of suit) incurred the Manager Parties related to, as a result of or arising from the actions of the guest and any occupants, including any negligent acts or omissions, willful misconduct, violations of laws or any obligations in this agreement, except to the extent such claims, demands and actions arise from the gross negligence or willful misconduct of the Manager Parties. Inspections While we respect the privacy of our guests, we maintain that we have the right to inspect the premises without prior notice at any time to enforce the terms of this agreement. We do this in the event that any guests are in violation of our house rules or in the event that we need to send out someone to tend to immediate home repairs. Should any guests violate any of the terms of this agreement, the reservation will be terminated immediately and no refunds will be given. The guests waive all rights to process if they fail to vacate the premises upon termination of their stay. The tenants shall vacate the premises at the expiration time and date of this agreement. Internet/Cable There is no Cable TV, however we do have high-speed internet throughout the house and each TV is set up with the most common streaming apps. No refunds shall be given for outages, content, lack of content, or personal preference with regards to the Wifi. Items Available Upon Request The following items may be available upon request but are not guaranteed and must be requested within at least 48 hours in advance: mosquito net, boardgames, children's dinnerware, highchair, outlet covers, pack-n-play, table corners, window guards, bread maker, luggage drop off. Additional charges for certain items may apply. Kayak & PaddleBoard Rentals The rental of our on site paddle boards and kayaks are free but the waivers must be signed prior, you are using them at your own risk. They are not to leave the property site. Life vests are mandatory for their usage. Life vests can be found in the communal living area near the grill. Directly under the communal bathroom. These free rentals are first come, first serve. Please be considerate of other guests. All items are to be placed back in the manner in which they were found. Laundry (where applicable) Feel free to use the laundry machines as needed. Wash and dry a load of all used towels as well as kitchen linens such as mittens and kitchen towels prior to checking out. If you need to place the cleaned towels somewhere please use our laundry bins. Limitation of Liability YOU UNDERSTAND AND AGREE THAT NO MANAGER PARTY ASSUMES ANY LIABILITY FOR LOSS, DAMAGE, CLAIM OR INJURY TO PERSONS OR THEIR PERSONAL PROPERTY WHILE ON THE PREMISES, NOR FOR ANY INCONVENIENCE, DAMAGE, CLAIM, LOSS OR INJURY ARISING FROM OR RELATED TO ANY TEMPORARY DEFECTS OR STOPPAGE IN SUPPLY OF WATER, GAS, CABLE SERVICE, ELECTRICITY, INTERNET SERVICE OR PLUMBING; CHANGES TO RENTAL ASSIGNMENTS; WEBSITE OR BROCHURE ERRORS; WEATHER CONDITIONS; NATURAL DISASTERS; ACTS OF GOD; OR OTHER REASONS BEYOND THEIR CONTROL. Locals Booking With Us If you’re a local or were a local, this information needs to be disclosed to us. Failure to do so can lead to us canceling your reservation without a refund. Lost and Found Oh no! You left something behind? We’ve been there! Valuable items left behind by guests will be held for the guest and every reasonable effort will be made to contact the guest for the return. After 15 days - items not claimed/retrieved, will be considered forfeited. Should you like us to mail your items back, the costs of shipping plus a $25 fee will apply that needs to be paid prior to the shipping. Mail, Packages, & Delivery If you intend to receive mail, a package, amazon, or any other delivery please notify us prior for our approval. Technically we don’t allow guests to send packages to the property because per Florida law a guest can claim proof of residency by receiving Mail at a location. Also, USPS won’t deliver per city laws to a property listed under the city as a short term rental unit. We can make an exception where if you message us stating “I, (your legal name) will not be residing as a long term tenant in this short term rental property. I will only be staying here as a short term rental vacationer and will only be receiving a package here during my temporary stay.” Just keep in mind USPS still won’t deliver to the address. But you shouldn’t have a problem with Amazon packages. Maximum Occupancy The maximum number of guests is 8. However, we may be willing to accommodate additional guests for a fee of $40 per night per guest if we have the proper resources available. We cannot make any guarantees that we will be able to honor your request but please reach out to us prior to booking as we view this on a case-by-case basis. All registered guests need to be approved. Any updates are subject to approval and a fee regardless if it's under the maximum guest count. Minor Differences in Rentals Sometimes we have incidents where guests steal, damage, stain, or break our home’s items. In these instances, we try to replace the item for the same exact item we had previously. Sometimes, this isn’t possible. Should you notice a particular decorative item in an image that is no longer there or is replaced with another decorative item, this is why. If you notice different bed sheets, or pillow cases, this can also be the reason. We’ve had a/c wall units need repair and we have temporarily replaced them with portable a/c units. Even down to patchy grass. We’ve had incidents where guests leave items on our grass and the grass dies. We mention all of this to say that it’s possible to experience slight differences in the listing images in comparison to your in person experience. Should you want to know what the possible differences can be, please ask us prior to your visit and we will inform you. Once you book, you agree that there is a possibility of minor differences in the home. Monroe County Ordinance & Other Applicable Laws All guests must abide by the City, State, Federal, and all other applicable laws and bylaws. Moving items Around Please leave all items and furniture in the same place you found them. Our cleaners are not movers and they will charge us additionally for this. The fees will be passed down to you. No Daily Maid Service While linens and bath towels are included in the home, daily maid service is NOT included in your stay. We provide starters for toilet tissue, paper towels, dish soap, garbage bags, and laundry detergent. Should you need any additional items, please let us know and we will do our best to accommodate you. However, it is not a guarantee. Occupancy Each home can allow up to two(2) adults per bedroom plus an added four(4) children under the age of 12. This means: -If there’s a 1 bedroom unit = Max 2 adults or 6 with 4 being children under 12. -If there’s a 2 bedroom unit = Max 4 adults or 8 with 4 being children under 12. -If there’s a 3 bedroom unit = Max 6 adults or 10 total guests with 4 being children under 12. And so on and so forth. Parking Please keep in mind there are only 3 parking spaces for this unit. The garage will fit two vehicles and comes with an electric vehicle charger. The garage door opener is not accessible on the outside, only on the inside. Our driveway will allow for 2 additional vehicles parked outside. Please DO NOT PARK on the grass, street, or on any neighbor’s property. Even though it's a duplex, please only park on the driveway pertaining to your unit. We will not be responsible for any parking tickets, parking boots, or towed vehicles. Parties & Events While we are all about having a good time, WE STRICTLY PROHIBIT ANY PARTIES OR EVENTS. This is to preserve the quiet neighborhood we’re in. Keep the party for the Las Olas night scene. You can be as loud as you’d like there. Music must be kept to a non-disturbing level during quiet hours and any conversations should be had inside the house, not near the street, front entrance, or even the patio/balcony areas. Please be mindful of the city-wide quiet hours from 10pm-8am and make sure that pre-approved extra guests leave by 12am. We greatly appreciate your compliance on this as we do not want any issues with our neighbors or the city. Please understand that any reports or evidence of a party or organized event taking place will be an automatic forfeiture of your stay without a refund as you will be in direct violation of house rules. Patio Furniture We hope you come to enjoy our outdoor spaces as most of our units do have them! Please keep in mind, that a lot of our outdoor furniture are not under covered areas which means they are susceptible to normal wear and tear, bird and animal droppings (we can’t control nature), wildlife (if bugs decide to crawl or lizard decide to sunbathe), rain, dust, dirt, pollen/leave stains, etc. We’ve noticed during certain timeframes we need to wash the outdoor patio furniture cushions much more frequently than others. Please note, some items may have been discolored due to pollen/leave stains and also the suns rays. The images portraying our patio furniture may differ in person because of this. It isn’t an indication that the unit is unclean, but rather that our patio furniture has been weathered. By booking with us, you agree to these terms. Pets YES! We have finally decided to allow pets into our home. There will be a $50 upfront fee per pet. There will also be a $45 fee per night per pet thereafter. The 1st nights fee will be waived with the initial flat fee per pet per stay rate of $50. Maximum of 2 pets per stay. Should you bring more than 2 please reach out as depending on the situation we may be able to accommodate you. Please ensure that you are following all local, state, and federal laws pertaining to your pets. Please ensure that you clean up after your furry family members. We will apply an excessive cleaning fee to unreasonably dirty homes. We do have a designated "Potty Area" for your pets in the backyard patio. However, it is YOUR responsibility to pick up after your pets. We want all of our guests to enjoy our patio without stepping on any unwanted surprises. Please ensure that your pets are never left unattended inside or outside of the home. This includes leaving pets unattended in enclosed patio areas. Please ensure that your pets are not creating a noise disturbance during your stay. If we receive more than 3 complaints, it may result in the termination of your reservation without a refund. Pets may NOT be on our beds, towels, bedding, sofas, or carpeted areas. An excessive cleaning fee will be applied if pet hair is found in these areas. Our cleaners charge us for this and so the fees will be passed along to you. Please make sure all PET FEES are paid PRIOR to your arrival or the entry code will not be given until it has been completed. All pets are to be leashed while outside at all times. Pool & Spa Our pools get serviced weekly. If you or a previous guest overdoes it on the sun screen, you might start to see a film or foam start to form at the top of the pool. Additionally, there's a lot of wind near the pool area so it may get filled with debris rather quickly. We can always call our pool guy to come out sooner and service the pool, but please keep in mind, it’s not guaranteed. Our spa is chemically balanced and chemicals are added as needed in between guests. There will be a timer to run the jets. Do not eat or drink in the spa as this can contaminate the spa causing an emergency treatment and incurring an added cleaning fee from our pool and spa technicians. There can be minor debris in the spa. No running, jumping, or diving in the pool or spa at any time. Swim at your own risk at all times. Parents must be responsible for their children. The pool is closed at sundown. No glass in the pool or spa area. Do not leave trash in this area. No parties or loud noise disturbances. Please be respectful of other guests. Starting November 11th, 2025 to November 25th, 2025 both the pool and spa areas will be getting worked on. This will be intermittent and can affect the use of these amenities throughout this timeframe. Please note that no refunds will be given as some days they will be available and other days they will not. Please read this and plan accordingly. Potential for Noise By renting out this property you further acknowledge and agree that since this home is located in a residential area, there is a possibility for noise that is outside of our control which includes but is not limited to: construction, loud noises from others nearby, and local events on-going. There is a possibility that construction might also occur on or nearby our properties due to a last minute repair that needs to be tended to. No refunds will be provided should this occur. Recording Devices & Noise Detection Devices If you’re staying in a home of ours with any of these devices, please assume that our devices are on at all times during your stay. Any and all recordings captured on our property remain our property. Our property is equipped with 5 exterior cameras. We have a door ring camera by the front door and a noise detection device near the kitchen/dining area. On at all times. The cameras have video and audio capabilities. Release of the Manager Parties In addition to the other specific releases set forth in this agreement and its addendum, you, for yourself, your heirs, assignors, executors, and administrators, and on behalf of each occupant of the property, and such occupants’ heirs, assignors, executors and administrators, fully release and discharge the Manager Parties from any and all liabilities, claims, demands, and causes of action which you, any occupant or their family members have or may have in the future by reason of any injury, loss or damage by whatever nature which has or have occurred, or may occur to you, or to any of the occupants during the stay as a result, or in connection with the occupancy of the property or in use of any item provided during your stay, including bikes, golf carts or other recreational items, including any claims, damages, costs or causes of action due to the negligence, breach of contract or wrongful conduct of any Manager Party, and agree not to sue and to hold the Manager Parties free and harmless of any claim or suit arising there from. Repairs and Replacements It is the guest’s responsibility to immediately notify us of any issues that they incur during their stay so that repairs and or replacement may be promptly taken care of to the best of our ability. We are not responsible for any occurrences over which we have no immediate control. These inconveniences may be but are not limited to, the following : weather conditions, power outages, adverse weather or road conditions, or breakage of non-essential appliances, including, but not limited to, dishwasher, grill, pool heater, washer, and dryer. *No rebate or discounts will be provided if there is a mechanical failure of any non-essential appliances, including but not limited to, the washer and dryer, pool heater, dishwasher, BBQ grill. Security When you leave the property and at night, please make sure all doors are locked and secured. Even though our home is in a safe neighborhood, we take the safety of our guests very seriously. Our security protocol includes 5 outdoor cameras and 2 sound level detection devices. The cameras are located in the following common areas: the entryway by the front door, the entryway of the garage, inside the garage, the entryway of the side patio door, the side patio walkway, and the backyard pool area. The sound level detection devices are located on each level of the house. One is attached to the ceiling in the kitchen area and another in the ceiling of the second floor hallway near the laundry room. Please note: These devices are not meant to micro-manage our guests. We do not have time to monitor or watch your every move. It is solely there to monitor any suspicious activity that will trip the alarms and cause us concern. In which case, we will check on the safety of our guests immediately. Security Guard Should we have to dispatch security to enforce, warn, evict, or for any other warranted reason to our residence at the time of your stay, we will pass along any fees associated with the dispatch to you. Fees passed along to you will still be your responsibility even if you end up being removed from our residence. Smoking There is to be NO SMOKING inside the property. Smoking is allowed outside on the patio (please utilize ashtrays - do not toss butts in the patio or rocks & PLEASE CLOSE ALL DOORS) or outside of the home. Any burn marks on outdoor furniture or evidence of smoking inside the home (ie smells of smoke, ashes, burns, etc) will cause for an automatic smoke remediation fee of $1000. Special Events & Gatherings Any and all planned or spontaneous special events or gatherings are subject to approval under stipulation that varies from property to property. They are also subject to a fee. If evidence of a special event or gathering has been discovered you will be asked to pay the fee and agree to our terms. If the event or gathering does not meet our stipulations or terms, the fee will still be expected to be due but the event and/or gathering will need to end immediately. Please know that any unauthorized events or gatherings are cause for a termination of stay without a refund. Streaming Services Please login to use your own streaming accounts. Pins will not be given to guests to download apps and services. If you need assistance with this, we may be able to help you on a case by case basis. TidePods & Other Essentials TidePods are now free! We provide a total of 5 TidePods and other essentials for your use. Please know it’s a starter pack. Conveniently, there’s a local grocery and drug store (Publix & Walgreens) less than a mile away should you need to purchase any extras! Toilets Part of being in Florida is understanding the sensitive nature of plumbing in a tropical environment. Pipes can clog easily and lots of homes are on septic systems. PLEASE DO NOT FLUSH PAPER TOWELS, TAMPONS, WIPES OF ANY SORT (NOT EVEN “FLUSHABLE” ONES), SANITARY NAPKINS, OR ANYTHING OTHER THAN TOILET PAPER. Trash All loose trash is to be bagged and put in waste bins provided. Trash receptacle location varies upon location. Please reach out if you have trouble locating the bins. The black bin is for all trash and the blue bin is for recycling. Please do not overfill trash in either of the bins. You will find trash bags under the kitchen sink. When the trash can is full, please remove the trash and take it to the trash bins. Please make sure all small trash cans have a bag liner before putting trash inside. Any excess trash, waste, or any other mess resulting in additional cleaning will be charged an additional cleaning fee of $300. Travel Insurance We HIGHLY recommend that you purchase travel insurance. NO REFUNDS will be made under our strict cancellation policy. Florida can have hurricanes and severe weather. Unforeseen events can occur and we will not provide a refund under any circumstances. Tropical Bugs & Other Wildlife We do our very best to keep any unwanted creepy crawlies from joining your group! This includes a monthly treatment to exterminate any bugs! Yet and still, we are in Florida and you might still see a spider in a corner, June bugs trying to fly in, and the occasional roach that will try to dry off after a rainy day. Please keep in mind, this doesn’t mean there’s an infestation, just a couple unfriendly critters wanting in on your fun! Either way, please let us know if you encounter them and we will try to get to it as soon as possible. Please note iguanas, lizards, and other wildlife can enter in backyards, patio spaces, balconies, and other outdoor spaces. Unauthorized Guests There are no unauthorized guests allowed without our expressed consent. If previously disclosed that other people will be in our home, they are to leave by 12am. Please do not allow extra guests to sleep at the house unless it was previously agreed upon from us when you booked the rental. All overnight guests must be listed with the booking. Any unauthorized guests will result in a direct violation of our house rules, and we reserve the right to cancel the stay immediately without any refunds. Unruly Guests We want everyone to have a good time in our home, but we have definitely had an experience with a large group that we gave multiple chances to, that still apologized to us and continued to turn around and be a nuisance to the property and our neighbors. Therefore, we have revised our rules to prevent an incident like that from ever repeating itself again. Please be advised that at the first mention of any complaint, evidence of rule violation, noise disturbance, or any other unruly behavior will result in your FIRST & FINAL WARNING. If necessary, we will dispatch security (at your expense) to relay any warnings or the hosts will contact you directly. Please note that any costs associated with the dispatch of security will be charged to the guests. Upon the SECOND complaint, noise disturbance, or unruly behavior, your entire group will be asked to vacate the property as you are in direct violation of our house rules. Your group will have 30 minutes to an hour to gather your belongings and exit the premises. In this process, we may invoke the assistance of local law enforcement officers. Waivers All waivers need to be signed and filled out prior to the use of our paddle boards and kayaks. Water Heater Near the dining room table you will find what appears to look at first glance like an AC thermostat. This is actually the water heater temperature control for the entire home. This should be left at 140 degrees to allow for constant hot water. Some guests lower this assuming it controls the AC. This will result in cold water for you! So please let it at 140 degrees. You will be able to adjust the heat for the water in the showers and faucets. No refunds will be given due to the confusion. Final Address Once again, we appreciate your compliance with these rules. We know this has been a mouthful. We aim to provide our guests with the best experience possible during their stay.
