RENTAL AGREEMENT This Short-Term Rental Agreement (“Agreement”) is made between the Guest ("You") and the Host ("The Grand Homestay") for the temporary use of the property for vacation or short-term accommodation purposes only. This is not a lease, and the Guest is not a tenant. The Host is not a landlord. The term of the agreement shall begin on the arrival date and end on the departure date for the reservation. By booking and confirming the reservation, the Guest agrees to the terms and conditions outlined below. SECTION A: GUEST RESPONSIBILITIES & HOUSE RULES 1. BOOKING & IDENTIFICATION REQUIREMENTS A government-issued photo ID must be submitted for all adult guests within 6 hours of booking. A photo of the guest holding their ID is required within 24 hours. The person who books must be the one staying at the property (no third-party bookings). All visitors must be pre-approved in writing at least 24 hours before arrival. 2. PAYMENT & SECURITY DEPOSIT A $1000 refundable security deposit is required. It will be returned within 48 hours of check-out, provided no damage, theft, or violations occur. 3. CHECK-IN / CHECK-OUT Standard check-in and check-out times are communicated in your reservation. Late check-out requires 48 hours’ notice and host approval (fees apply). Unauthorized late check-outs may incur penalties up to $500. Overstays or entry after checkout time may result in removal from the property. 4. PARTIES & EVENTS Parties, events, or gatherings over 15 people are not allowed without written host approval (including number of guests, cars, etc.). Evidence of unapproved gatherings may result in immediate cancellation without refund. 5. QUIET HOURS Weekdays: 10:00 PM – 8:00 AM Weekends: 11:00 PM – 8:00 AM No loud music, shouting, or disruptive behavior at any time. 6. SMOKING, VAPING & DRUG USE No smoking or vaping indoors. Use is allowed only in designated outdoor areas. No drug use (including recreational marijuana or illegal substances) is permitted. $300 penalty for evidence of indoor smoking/vaping or use in non-designated areas. 7. CLEANLINESS Guests are expected to leave the property tidy. Excessive mess will incur additional cleaning fees. Trash must be sorted and disposed of in designated bins according to provided instructions. 8. PROPERTY RESPECT & DAMAGE Do not move, remove, or damage furniture or items. All items (excluding consumables) are the homeowner’s property and must remain onsite. Missing or damaged items will be charged, with lost remotes or keys incurring $150 per item. Theft will be reported to authorities 9. USE OF PREMISES The property is to be used solely for temporary, personal lodging by the registered Guest(s). Guest acknowledges that this is a license agreement and not a lease, and does not create a landlord-tenant relationship. The Host retains the right to access the property for emergencies, maintenance, or inspections with reasonable notice. 10. REMOVAL FROM PREMISES & ILLEGAL EXTENSIONS The Host may terminate this Agreement and remove the Guest immediately if any of the following occur: Violation of house rules Disturbance to neighbors Property damage Unauthorized occupancy beyond approved guest count Refusal to vacate after check-out Illegal extension of stay without Host’s written consent The Guest waives any right to remain on the premises beyond the agreed check-out time unless explicitly extended in writing. No refunds will be issued if removal is due to Guest's misconduct. In the event of continued overstaying and refusal to vacate the Property, the Host reserves the right to pursue legal action to recover possession of the Property and seek damages for any losses incurred. 11. FILMING. No professional photography or videography is permitted on the premises without prior written consent from the host. This restriction is in place to ensure the security, privacy, and quiet enjoyment of the property and neighborhood. 12. NO PARTIES OR EVENTS Parties, large gatherings, or events of any kind are strictly prohibited on the property, unless expressly approved in writing by the Host prior to check-in. A $500 fee may apply for gatherings. Unauthorized parties or events will result in immediate termination of the stay without refund, and may incur additional cleaning, damage, and disturbance fees. 13. EXTRA GUESTS Only the number of guests listed in the reservation is allowed to stay overnight. Additional daytime or overnight guests must be requested and approved in writing before arrival. A $35 per guest fee may apply for extra guests. SECTION B: AMENITIES & SAFETY 1. POOL / HOT TUB USE (IF APPLICABLE) By using pool or hot tub facilities, you agree to: Swim at your own risk. Supervise children under 12 at all times. Refrain from running, diving, or rough play. Avoid using glass in or near the pool. Not use these facilities while intoxicated or ill. The Host is not liable for injuries, accidents, or health issues from use. Guests are responsible for any damage caused to pool equipment or areas. 2. PARKING Each property offers private parking, typically including a gated driveway and a garage. Street parking is not permitted. Guests are responsible for any towing fees resulting from parking violations. 3. SECURITY CAMERAS Exterior security cameras are installed for guest safety and property monitoring. No cameras are installed inside the property. Footage may be used to verify rule violations. SECTION C: PET POLICY (if applicable) Pets are only permitted if pre-approved by the Host, with applicable pet fees paid in advance. By bringing a pet, you agree to: Accept full liability for any damage, injuries, or disturbances caused by your pet. Supervise your pet at all times and follow local pet laws. Clean up after your pet and prevent damage to furniture, flooring, or landscaping. Pets with a known history of aggression are not allowed. Unauthorized pets may lead to additional charges or removal from the property. Note: Emotional support animals are not recognized as service animals in this jurisdiction. SECTION D: LIABILITY & DISPUTE RESOLUTION 1. GUEST RESPONSIBILITY You are responsible for the actions of everyone in your group during your stay. You accept liability for any property damage, theft, or rule violations. Charges may be applied to your security deposit for any infractions. 2. PERSONAL PROPERTY AND LIABILITY. All personal property kept by Guest in said property shall be and remain at his/her sole risk and GHS shall not be liable for any damage to, or loss of such personal property occurring from any acts of negligence of any other persons, nor from any problems with the rental home from any other cause whatsoever, nor shall GHS be liable for any injury to Guest or guests of Guest in or about the property. Guest understands that any personal property of and used by Guest is not insured by GHS. Guest expressly agrees to hold GHS and the property owners harmless in all such cases. 3. GOVERNING LAW AND VENUE: It is expressly agreed that the exclusive governing law, including the laws covering this Agreement, shall be the laws of the State of Nevada, irrespective of the state of residency of the Guest. The sole and exclusive venue (i.e., place where a lawsuit may be filed) for any legal proceedings shall be the Nevada State Court, either Superior or Municipal, in Clark County, Nevada. Guest(s) expressly waive any other right or privilege with respect to the election of the venue or court (i.e., state, or federal) and location of the venue of action. The parties below agree to the terms stated above and have read, understood, and agree to the terms and conditions, and acknowledge their right to consult an attorney before signing this Agreement. 4. DISPUTE RESOLUTION All disputes shall be resolved through binding arbitration with the American Arbitration Association (AAA). The Guest waives the right to a jury trial and class action participation. Arbitration proceedings will remain confidential. Any claims must be filed within one (1) year from the date of the incident. SECTION D: MISCELLANEOUS 1. LISTING INFORMATION AND MODIFICATIONS All property-specific details (amenities, rules, check-in/out times, cancellation policy) are outlined in the booking platform listing or provided directly by the Host. The Host reserves the right to modify or update house rules at any time prior to the Guest’s arrival. Material changes will be communicated in writing. 2. CONFIDENTIALITY: Guest agrees not to disclose terms of this Agreement or any private disputes to third parties, including public review platforms. 3. CHILD PROOF: Guest understands that no special efforts have been made to "childproof'' this home and accepts the risk of harm to any children and/or senior adults allowed on the property. These risks include but are not limited to direct access to Pool, Hot Tub, Falling, ingestion of cleaning supplies in the property and on the street, and the use of stairs inside and outside of the property etc (if applicable). 4. REPAIRS AND MAINTENANCE: The Property is rented with the Owner’s furniture and household furnishings. The owner shall not be responsible for providing additional furnishings or equipment not presently available in the Property. Renter will report any maintenance issues immediately to the Owner. The Owner will make every effort to repair and/or replace any equipment that is not working properly but cannot guarantee that all equipment is in good operating order at all times and no rate adjustments or refund will be made for equipment or appliance failures. 5. NO SUBLETTING: Renter may not sublet or assign this Lease for all or any part of the premises without the prior written consent of the Owner. 6. INDEMNITY: Renter hereby agrees to Indemnify and hold the Owner harmless from any and all claims, including those of third parties, arising out of or in any way related to Renter’s use of Property or the items of personal property provided therein. Renter assumes all risk of injury or other losses relating to any recreational activities, including the use of any swimming pool on the Property, and will hold Owner harmless with respect thereto. SECTION E: FINAL ACKNOWLEDGMENT By completing this booking, I confirm that I: ✅ Have read and understood the terms of this Agreement ✅ Agree to follow all house rules, policies, and responsibilities ✅ Accept full liability for the actions of my group and any approved pets ✅ Accept full responsibility for using property amenities, including pools and hot tubs ✅ Understand that violation of any rules may result in penalties, eviction, or withheld deposit BY SIGNING BELOW GUEST DECLARES THEY HAVE READ FULLY THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT BY SIGNING THIS, THEY HAVE GIVEN UP SUBSTANTIAL RIGHTS ON THEIR OWN BEHALF AND IF APPLICABLE ON BEHALF OF THE GUEST'S MINOR CHILD OR MINOR FOR WHOM THEY HAVE RESPONSIBILITY. GUEST FURTHER DECLARE THAT THEY HAVE SIGNED THIS AGREEMENT FREELY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT. BE AWARE THAT BY SIGNING, YOU ARE ACCEPTING ANY AND ALL RESPONSIBILITY FOR YOUR ENTIRE PARTY AS WELL AS YOURSELF. I AM THE FOLLOWING MINOR'S PARENT AND/OR LEGAL GUARDIAN AND/OR TEMPORARY GUARDIAN PURSUANT TO THE PERMISSION OF THE MINOR'S PARENTS AND/OR LEGAL GUARDIAN, BY SIGNING BELOW AND WRITING IN THE MINOR(S) NAMES, I UNDERSTAND THAT I AM SIGNING ON BEHALF OF THE LISTED MINOR(S), EXECUTING THIS RELEASE AND WAIVER OF LIABILITY, EXPRESS ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT ON THEIR BEHALF, AND AGREE THAT THE TERMS OF THIS AGREEMENT SHALL APPLY TO THE MINOR AS IF THEY WERE THE "GUEST" AS THAT TERM IS DEFINED IN THIS AGREEMENT.
